A child aged under 16 years is Gillick competent if they are assessed as having the mental capacity to make their own decisions and provide valid consent.  The assessment is based on the child’s ability to understand the nature of the decision and to weigh the implications, advantages and risks to reach an informed decision or provide consent.  Where a child is aged 16 years or over, the Mental Capacity Act applies.
